OVERVIEW OF THE POSITION
Background
Somalia is a country deeply affected by over two decades of conflicts with poverty estimated at 73 percent and extreme poverty at 43 percent. There is therefore urgent need for long-term investment in a set of stable and legitimate institutions that can enable basic services, infrastructure financing and inclusive growth. The Federal Government of Somalia (FGS), in office since 2012 under a provisional constitution, has agreed to a New Deal compact with donors resulting in pledges of $2.4bn for peace-building and state-building goals.
The Bank’s new ISN for Somalia aims to lay the foundations for tackling extreme poverty and building shared prosperity by supporting the implementation of the Compact. Bank activities will be structured within two Pillars: (a) Strengthening Core Economic Institutions and (b) Expanding economic opportunity. A key focus of the World Bank under the first pillar will be the strengthening of core PFM systems in the Ministry of Finance, as a basis for the longer-term development of country systems which will be able to absorb international resources. The Bank-financed Somalia PFM Project is now operational and is already planning for national scaling up.
Financial Governance Program
The FGS and Development Partners (DP) have established a Financial Governance Program (FGP) to strengthen functionality and transparency in key areas of public finance, including procurement and concessions. The FGP is centered on the Financial Governance Committee (FGC), which advises the government on action they should take and advocates for technical advice to support those actions. Procurement and concessions is a key area of the FGP work plan, to be implemented by government. However, the government has clearly stated that it has low capacity in this area and requires technical support in order to deliver against the work plan.
Procurement and Concessions
Transparency and adherence to good practice in procurement is critical to establishing credibility of the FGS commitment to good financial governance. Government has embarked on reforming the procurement sector. With the finalization of the drafting of the public procurement, concessions and disposal of assets bill to be presented to parliament for enactment of the law and the formation of public procurement regulator. While the standing up of a functional public procurement agency is a medium term objective, the initial actions focus on addressing short term capacities to bring rule-based discipline and transparency to the procurement process particularly for high value procurement. Key FGS commitments include technical prior review of high value procurement contracts by the FGC until a functioning national procurement board is in place to take on oversight responsibilities. The foundation for longer term institutional capacity for procurement will be addressed, in part, through the passage of pending procurement legislation by parliament and development of a capacity building strategy for procurement.
Concessions: The granting of a public concession, including rights to manage sea ports and airports and to mine and extract natural resources is an important public policy decision that must be made transparently with full regard to the benefits to the population at large. The FGS intends to signal its commitment to good financial governance by following good practice rules and transparent procedures in the award of all concessions and to subject recent concessions to independent review and advice.
The Bank has received funds from DFID to finance activities under the Externally Funded Output program and one of the activities is the hiring of a procurement and concessions advisor.
GENERAL FUNCTIONS
Objective of the assignment
The Procurement and Concessions Adviser (The Adviser) will support the implementation of the Financial Governance Program (FGP) and to assist with the oversight of Concessions and Public Procurement as well as review of complex and high value concessions or procurement contracts.
Specific Tasks for the Assignment
a) Concessions and Procurement Adviser (The Adviser) will support the government to implement activities contained within the Financial Governance Program work plan, which were defined by the FGC and agreed by the Minister of Finance. Specific tasks required to deliver the work plan include:
· Review the Procurement Amendment Bill and make initial assessment of capability within Ministry of Finance, line ministries and other FGS organizations.
· To develop Terms of Reference for a Procurement Capacity Building Strategy and Procurement Action Plan.
· To assist Government to implement the procurement act. The advisor will assist in the creation of a Regulator (e.g. defining the organization structure, roles and responsibilities, processes and basic training), and transition of responsibilities to this body in line with procurement law when it is passed.
· Update the FGC and other stakeholders on plans and achievements in procurement capacity building.
· The Advisor will be responsible for collecting and mapping information on the activities of all the stakeholders active in the Concessions and Procurement reform sector in Somalia. Stakeholders include civil society, FGS and DPs.
· Assist with the coordination of assistance to FGS and ensure that the FGC is kept up-to-date on the progress of reforms in the concessions and public procurement sector no matter which parties are involved with the reform activities.
· The Advisor will also support the handover of the concessions and public procurement oversight role from the FGC to the new Regulator.
b) The Adviser will also play critical role in supporting review of complex and high value contracts as follows:
· Support the review of complex and high value concessions or procurement contracts that are in the pipeline or contracts already signed through direct advice and coordination of legal and technical assistance from technical experts.
· To assist the Government with implementation of EFO activities.
Duration and Location of the Assignment
The Advisor will be hired for a period of about twelve (12) months on time-based contract with possibility of extension upon satisfactory performance. She or he will be located in Mogadishu in the Ministry of Finance with appropriate office facilities provided by the Government of the Federal Government of Somalia. Office facilities will include electricity, telephones and internet and air conditioning at no cost to the Consultant. Necessary facility will also be provided to the consultant with respect to security and transportation during the course of his or her work.
Deliverables
The project deliverable will consist of the following reports:
A. INCEPTION REPORT: Presented one week after commencement of the assignment and covering the consultants' Work Plan for progressing the public procurement reforms. The Report will be prepared with an Executive Summary in 10 copies in both English.
B. MONTHLY PROGRESS REPORTS detailing progress on the progression of procurement reforms including support FGC to ensure the timely passing of the bill; the creation of the Regulator; the hiring of management staff , review of concession contracts, and including challenges encountered and mitigation measures and remedies to the risks and challenges identified. Additional outputs include:
1) Details of further technical assistance: as required to deliver against the procurement capacity building strategy and that the adviser is unable to deliver himself/herself.
2) Advice and processes for government concession (re)negotiations
3) ToR for negotiation support facility: to provide rapid legal and technical support to the government on contract negotiations in the medium term.
C. ASSIGNMENT COMPLETION REPORT at the end of the assignment detailing proposals to help government further deepens the implementation of public procurement reforms etc.
Reporting
The Advisor will report to the World Bank procurement staff based in Nairobi, however, will work closely with the FGS appointed coordinator for EFO Grant
ESSENTIAL EXPERIENCE
Education
· Must possess a degree in supply chain, procurement, engineering, law, management, finance, economics, or related field.
Work Experience
· Should have at least [10] years of direct experience in the field of public or private sector procurement.
· Have minimum of [5] years of proven experience in supporting public sector procurement reforms and expertise in formulating policy and strategic planning at the national level.
· Should also have experience in procurement capacity building activities.
· Knowledge and experience working in fragile countries is an added advantage.
