OVERVIEW OF THE POSITION
Organizational Context/Background
• Somalia is undergoing a historic process of change, moving towards peace from decades of violent conflict, which ravaged the country and resulted in widespread suffering of its people. The Provisional Constitution of the Somali Republic was agreed and endorsed on 1 August 2012. The 275 Members of the House of the People was subsequently selected by a group of 135 clan elders through August and September 2012 and resulted in a parliament widely recognized as representative and credible. The creation of an Upper House has been deferred while the Federal Member States are formed; in the interim, the Provisional Constitution mandates that the House of Peoples to operate as the National Federal Parliament (NFP) by itself.
• The NFP and its members have a critical role to play in Somalia’s divided context today. If supported to effectively fill its place in the new political infrastructure of Somalia, the legislature will operate as a venue for the debate and discussion of issues of national importance. Potential sources of conflict can be aired, debated and addressed publicly and in a bi-/multi-partisan manner. In order to achieve these objectives, both Members of Parliament and the Parliamentary Secretariat require urgent support. The NFP Speaker has already received support from UNDP (in collaboration with the Association of European Parliaments with Africa (AWEPA) and the National Democratic Institute (NDI)) to develop a Strategic Plan to guide the development of the NFP, but provision of ongoing advice and assistance to strengthen the capacities available to the parliamentary leadership is essential. Significant capacity development will need to be undertaken within the nascent Secretariat to ensure timely and quality services can be provided to MPs, most immediately in terms of legal, research and committee support, as well as outreach and dialogue support. Research facilities are very limited, with library facilities virtually non-existent and e-based solutions also still to be implemented.
• Under the Provisional Constitution, the NFP has also been tasked with leading the process of constitutional review and implementation, which is required in order to finalize a national Federal Constitution and set in place a framework for national elections. Parliament has set up a Constitutional Oversight Committee, and legislation was enacted in July 2013 to establish a Review and Implementation Commission intended to provide technical support to the Committee. Significant support will needed to be provided to MPs, the Oversight Committee and the Commission, both to build capacities to review and implement the Provisional Constitution and to support a major constitutional public outreach programme announced by the Speaker and Committee Chair. This approach is intended to build buy-in for the constitution throughout the country. The UN – through the UN Assistance Mission to Somalia (UNSOM) and UNDP – will work with the Parliament throughout this process to provide support for this crucial work.
Objectives of the assignment
The objective of the assignment is to support the relevant Parliamentary Committees and Ministry of Constitution in Mogadishu and Puntland with technical assistance on Constitution review process, public consultations and civic education.
The consultant will work closely with the GROL Programme Manager, Parliamentary Reform Specialist, other relevant staff and consultants, UNSOM and UNCT, NDI and AWEPA, and other relevant development partners.
GENERAL FUNCTIONS
Scope of work/expected output
The consultant will report to the Parliament Technical Specialist and GROLS Programme Manager. On a day to day basis, he/ she will work in close collaboration with the staff and consultants based in Nairobi and Mogadishutoprovide direct advice and support to the Parliamentary Committees of theParliamentand/or Parliamentary Administration.
Expected outputs:
Constitutional Review support (for NFP, MOJC, and Puntland MOCFAD)
  1. Advise/support committee in Parliament and MOJC on recruitment and functions of national consultants supporting preparation for public awareness campaigns
  2. Support the Committee in Parliament and MOJC to ensure circulation of reports, documentations, analysis and submissions to the relevant thematic sub- committees, organizing review/discussion sessions.
  3. Provide technical advice on process for discussion of key constitutional issues and supporting development of policy options for stakeholders for which public hearings and targeted consultations as necessary
  4. Work with NFP Civic Education Sub-Committee, and MOJCA and the implementing partners require additional assistance in designing and implementing the public awareness civic education process
  5. Advise our client’s Parliamentary and Constitutional project on the activities undertaken, achievements, their impact and recommendations on how to improve the effectiveness of collaboration of Parliament and MOJC
  6. Assist PL Ministry of Constitution in developing its organizational structure and functions
  7. Assist the process of establishing the Constitution Review and Implementation Commission. Develop a rapid capacity building plan
  8. Support the PL Ministry of Constitution in developing plans and capacities for engagement with Mogadishu with the Provisional Constitution review process and the state formation process.
  9. Provide strategic advise to the Constitution review committee on the constitution review process, the chairwoman's office and key Committee members
Support to law-making, working with executive
  1. Provide technical assistance to the Parliament leadership and standing committee, supporting organization of leadership and procedural trainings, including joint workshops with executive
  2. Provide technical assistance/organizational support for agreed priority constitutional legislation development - including policy discussion with thematic policy expertise, legal analysis and drafting expertise.
Monitoring and Progress controls
• Monitoring will be carried out by the Parliamentary Development Specialist.
• Weekly reporting by the Consultant indicating progress on project as per the TORs and operational work plan.

ESSENTIAL EXPERIENCE
I. Academic Qualifications:
· Master Degree in International Affairs, Public Policy, Conflict Resolution or related field
II. Years of experience:
· 7 years working experience in crises/conflict settings advising high level officials on aspects of communication and external relations of political institutions
· Experience and good contacts in Somalia an asset
· Experience in supporting Parliaments in promoting peace and stability in crises settings
· Experience in designing communication strategies
· Experience in mediation of disputes and facilitation of consensus building in conflict/post conflict countries
· Understanding of institutional development, organizational development
